For all the gamers out-there (OpenGameLuncher)

Hey everyone. Made a small little open-source game luncher for open-soruce games.

So its easier to hop into them, and keep the games updated. Feedback appreciated ๐Ÿค

Ai slop? Maybe

Not even legally open source? Why the fuck?

At least in the US, the copyright of a work is created by the act of a person making it. Works created by AI categorically cannot be copyrighted.

This has been brought to courts and their stance on the issue pretty blunt. Verbatim, the courts have said "human authorship is an essential part of a valid copyright claim", and "[copyright] requires all eligible work to be authored in the first instance by a human being" (Thaler v.ย Perlmutter)

The US Copyright Office also has been pretty blunt and keeps reaffirming their position year after year. Quote, "the author of a copyrighted work is the person who translates an idea into a fixed, tangible expression entitled to copyright protection".

In order to license a piece of software, you either need to own it, or you need to get permission to re-license it from the owner. Neither can be done in the case of code that has no "author".

Sure thing, I'm not arguing with that, but Llms and other models are tools in the hands of forementioned authors, which defines the works as created by them, you see

So yes, if it was an automated "thingamajig" that went and made a bunch of shit on its own you could say it's not their work, but if you're involved? Then it is your work, at least for now, going by current definition

You see, if I manage a codebase and use tools to help with that, it is still my codebase, it has an author, or an organization behind it, it didn't appear from thin air, it appeared from a person's intention

Like sure, there are idiots who vibe code the entire thing without understanding a word it says, those people don't have a chance, but how are you going to prove which parts are LLM and which aren't when project is maintained and curated by real developers who understand the intent behind each line of that code and can explain it to you?

In the context of OP, it doesn't matter too much because nearly the entire thing was vibe-coded by Claude, including the commits that are "from" OP.

In the context of OP, perhaps, but I'm talking in general

Well, in general:

Not even legally open source? Why the fuck? [...] Llms and other models are tools in the hands of forementioned authors,

Decompressing data someone else wrote is not authorship. This issue has been brought to courts in the US, China, a few EU member states including Italy, South Africa, Indonesia, and a few other countries.

but if you're involved? Then it is your work, at least for now,

As far as the more nuanced issue of code that you partially wrote, FAQs from copyright offices and court precedent state that you would only partially own the code you partially wrote. Copyright necessarily requires human authorship in almost every country that has copyright laws.

how are you going to prove which parts are LLM and which aren't

That part is kinda annoying. Some AIs leave data encoded within the text itself which is very helpful, but that's not a universal and inalienable truth as you have pointed out. Some cases are extremely cut-and-dry like OP, though, which is nearly 100% "written" by Claude.

Welp, corpos just won't let it change into "no ownership" cuz everyone is invested into the stuff and is shipping it commercially already, rn the trick is to protect it all under "trade secret"

ai breaks the legality of source available projects as it is counted as a derivative

1

u/sTiKytGreen 10d ago edited 10d ago

In which jurisdiction? I don't remember this being settled and written into a law

No matter how hard you want this statement to be true, it isn't until it's a common legal practice written into a law, and corps ain't letting that happen nowhere in this timeline

As for my perspective: every single piece of work, of any kind, in human history, is a derivative work, let's ban copyright then

Easy answer it's a License Breach, but more so the fact it's listed as mit even though An MIT license only applies to code the creator legally owns or has clear permission to give away. He has neither since you cant put any license on ai code.

0

u/sTiKytGreen 9d ago

Yeah, but the definition of legally owning it is what's under discussion and question rn, so it doesn't invalidate it for the time being

You're not stealing code, you're making your own, if you are providing the input and directing the LLMs and the project, as of now it's legally yours, and unless you can show me a legal document proving otherwise i don't see a point in this argument

2

u/pixel8441 9d ago

The only thing you own for licensing when using an llm Is the prompt not the generated prompt

0

u/sTiKytGreen 9d ago

"The only thing you own for licensing when using a DAW is the pipeline, not the song", "The only thing you own for licensing when making an SVG logo is the text file, not the produced image"

Should I continue?

2

u/pixel8441 8d ago

No because that's some really shitty examples

-1

u/sTiKytGreen 8d ago

Eh, pretty simmilar to the one you gave bro

2

u/GenericFoodService 8d ago

Copyright requires human authorship in almost every single country that has copyright laws.

A DAW is a program that provides an interface that makes original human authorship of music easier.

SVG is a file format. Whether or not an image can be copyrighted depends on whether or not it is a sufficiently novel work. Images that do not have human authorship cannot be copyrighted.

-1

u/sTiKytGreen 8d ago

A DAW often uses pre-made samples, in that case work still can be copyrighted, it's a derivative

Some with llms, even if code counts as "public domain", if you work no it your changes become a copyright able derivative

if you are providing the input and directing the LLMs and the project, as of now it's legally yours

The United States, China, and as far as I am aware most EU Countries and the EU itself have been consistent that copyright necessarily requires human authorship.

And to be clear, you are stealing code. These LLMs are "transformers" which lossily compress and then decompress text from a corpus of other people's often-unlawfully-uncredited work.

You can argue about how much you "direct" the plagiarism machine all you like, but compressing and then decompressing someone else's code, linting it, removing comments, whatever, do not change the fact that you are not the original human author.

Feels like ๐Ÿ˜… Even if they mention games like every 5 years again. But im totally fine that some games like OTTD work. They are simple, retro and fun

slapping a copyright notice and MIT License on top of software you did not write which you cannot copyright is pretty silly

OGL is a hobby project. I love open-source games, but I got tired of the hassle: every game has its own website, its own download page, its own way of updating. I wanted one place that installs them, keeps them up to date, and starts them. So I built it.

There is flathub and nix for that at least for linux. I don't use game launchers but i wonder why not just collaborate with heroic game launcher?

1

u/Big_Whale_95 10d ago

I see. i jsut did it for my self as im very used to do my own things by now. So i Thought why not jsut give it if someone wants it. But ill check out heroic too ๐Ÿค

I like it. Donโ€™t let the haters drag you down. I think itโ€™s a neat ideaย
