Other Red Civic driver who hit a rug(?) On hwy 89

First, well done keeping your composure under immense pressure. Second, I don't know it is helpful for your insurance, or for a police report? But I have the license of the Ford Ranger that kicked the rug up off the road if you need it or want it. I assumed you couldn't see it with the rug on your windshield 👍

Edit for clarity, it happened at the I-15 hwy-89 interchange in Farmington

Unless it fell out of the ranger, I don't think they would be liable for kicking up road debris

This is correct. If you hit something that is already in/on the road, it is a road hazard. Example, if a piece of a tire (or carpet) is in the road and you hit it and it flies up and hits the car behind you, it’s simply a road hazard. If that piece of tire comes off your tire, lands on the road and the guy behind you hits it, it is simply a road hazard. If that piece of tire comes off your tire and hits the car behind you before it lands on the road, you are potentially liable. If a rock(s) comes off or out of your truck and chips a windshield, you are potentially liable. If your tire flips a rock from the road up and breaks a windshield, it’s a road hazard. I’m a truck driver and I know this from being on both sides of the issue.

I'm not certain. But insurance companies might say otherwise when handling a claim, which is why I put this out there

My father worked in insurance handling claims for 30 years. The ranger isn't liable. It's like having rocks kicked into your windshield, the chances of their insurance covering that is very slim.

From my understanding, pretty much the only time their insurance is gonna get involved is if you can prove beyond a reasonable doubt that the damage to vehicle B resulting from debris was directly attributed to vehicle A, usually in the form of negligence.

Like if someone is hauling something in the bed if their truck that they didn't strap down, and it falls out and hits your car, and you have proof. Then you can argue they're at fault.

But that doesn't apply to debris in the road generally that was unrelated to either involved party.

I’ve had insurance push back on road debris claims before. Like wanted to treat it like I bumped into something on accident and have it at-fault.

Having a witness that says otherwise can help in that scenario to have it listed as no-fault.

But other than that, yeah they’re not going to go after whoever just kicked something up.

Yeah, insurance will always find any reason not to pay, there is no way the trucks insurance will be even slightly open to the idea that they should cover this (based on what I’ve read.

That rug really tied the highway together.

Can you specify where on 89? That runs the length of the state.

Good point, it happened in Farmington where 89 breaks off from I-15

Between Treemonton and St. George.

Jokes on you. 89 doesn’t go to either Tremonton or St George.

It was somewhere between Bear Lake and Lake Powell.

Oh man! I don't know why I read 89 and thought I-15. Probably the weed. Thanks for pointing that out. I have to leave it up now.

I had to double check that we were talking about 89, because I had thought 15 as well.

I was going to accuse you of working for KSL, which sometimes is geographically challenged.

I would say it's a zero chance that the Ranger is held responsible for kicking up the carpet. How was it his fault?
